Terms of Service

1. Agreement

By accessing or using Trakt, you agree to these Terms of Service. If you do not agree, do not use the service. These terms are a binding agreement between you and TRAKT LLC

2. The service

Trakt provides an AI intelligence and trust-layer platform. The intelligence side observes and reports what AI models say across providers and contexts. The trust side lets organizations publish signed, verifiable commercial state that agents can check independently.

3. Eligibility

You must be at least 18 years old and capable of forming a binding contract. If you use Trakt on behalf of an organization, you represent that you have authority to bind that organization.

4. Accounts

You are responsible for keeping your account credentials secure. You may not share credentials or use another person’s account without permission. Organization account owners may manage memberships and roles.

5. Acceptable use

You may not use Trakt to:

  • Violate any law or regulation.
  • Post, store, or process illegal, fraudulent, or infringing content.
  • Attempt to gain unauthorized access to the service or other users’ accounts.
  • Interfere with the integrity or performance of the service.
  • Use the service to generate or distribute deceptive or harmful content at scale.

6. Your content

You retain ownership of any content you submit. You grant Trakt a limited license to process, display, and store your content solely to provide and improve the service.

7. Generated output and AI disclaimer

Trakt uses third-party language models to observe and compare answers. Model output is probabilistic and may be inaccurate or incomplete. You are responsible for reviewing any output before relying on it. We do not guarantee that AI-generated observations are factual, current, or complete.

8. Third-party services

The service depends on third parties, including OpenAI, Gemini, Perplexity, Stripe, and QuickNode. Your use of the service is also subject to their applicable terms and policies. We are not responsible for third-party outages or changes.

9. Payment and billing

Subscription and usage fees are charged through Stripe. By providing payment information, you authorize us and Stripe to charge the applicable fees. Subscriptions may auto-renew until cancelled. You can cancel at any time through your billing settings.

10. Intellectual property

Trakt and its branding, code, and documentation are owned by TRAKT LLC or its licensors. These terms do not grant you any right to use our trademarks or other intellectual property without our written permission.

11. Termination

You may close your account at any time. We may suspend or terminate your access if you violate these terms or if necessary to protect the service or other users. Upon termination, your right to use the service ends immediately.

12. Disclaimer

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

13. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, TRAKT INC. AND ITS AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, OR FOR ANY TOTAL LIABILITY EXCEEDING THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS. SOME JURISDICTIONS DO NOT ALLOW THESE LIMITATIONS, SO THEY MAY NOT APPLY TO YOU.

14. Indemnity

You agree to indemnify and hold harmless TRAKT LLC and its affiliates from claims, damages, and expenses arising from your use of the service or your violation of these terms.

15. Governing law and venue

These terms are governed by the laws of the State of Delaware, without regard to conflict-of-law principles. Any dispute arising from these terms or the service will be brought in the state or federal courts located in Delaware.

16. Changes

We may update these terms from time to time. The updated version will be posted on this page with a new “Last updated” date. Your continued use of the service after changes are posted constitutes acceptance of the updated terms.
